By creating an account or using Healix ("the Service"), you agree to these Terms of Service ("Terms"). If you do not agree, do not use the Service.
The Service is operated by MioMarker ("we," "us," "our") and available at usehealix.com and through the Healix mobile application.
You must be at least 18 years of age to use the Service. By using Healix, you represent that you are 18 or older and have the legal capacity to enter into this agreement.
Healix is not a medical device. The Service is not intended to diagnose, treat, cure, or prevent any disease or medical condition. Healix has not been evaluated or approved by the U.S. Food and Drug Administration (FDA) or any other regulatory body.
Healix does not provide medical advice. All information, content, and AI-generated responses provided through the Service are for general wellness and informational purposes only. This includes, without limitation:
No doctor-patient relationship. Your use of Healix does not create a healthcare provider-patient relationship between you and MioMarker or any of its employees, contractors, or affiliates.
Consult your healthcare provider. Always seek the advice of a qualified healthcare professional with any questions regarding a medical condition, health concern, or before making any changes to your diet, exercise, medication, or health regimen. Never disregard professional medical advice or delay seeking it because of information provided by Healix.
Not for emergencies. Healix is not designed for use in medical emergencies. If you are experiencing a medical emergency, call 911 or your local emergency services immediately.
Data accuracy limitations. Health metrics, scores, AI analysis, and nutritional estimates are approximations and may contain errors. Biomarker extraction from uploaded documents uses automated processing that may misread or misinterpret values. You should always verify important health data against your original lab reports and consult your healthcare provider for interpretation.

The Service is provided for personal, non-commercial use. We reserve the right to modify, suspend, or discontinue any part of the Service at any time.
Certain features of the Service are available only through a paid subscription.
You are responsible for:
You may only create one account per person. You may not share your account with others or use another person's account.
You own your data. All health data, documents, meal logs, and other content you provide to Healix remains your property.
By using the Service, you grant MioMarker a limited, non-exclusive license to process, store, analyze, and display your data solely for the purpose of providing and improving the Service. This includes sending relevant data to AI providers for processing as described in our Privacy Policy.
You may delete your data at any time through the Service or by contacting us. Upon account deletion, your data will be removed in accordance with our Privacy Policy.

The Healix AI assistant uses third-party large language models to generate responses. You acknowledge that:
The Service — including its design, algorithms, software, visual elements, branding, and documentation — is owned by MioMarker and protected by applicable intellectual property laws.
Your health data remains yours. MioMarker claims no ownership over the content you upload or provide to the Service.
Healix integrates with third-party services including Apple HealthKit, Supabase, and OpenAI. We are not responsible for the availability, accuracy, or practices of these third-party services. Your use of third-party services is subject to their respective terms and privacy policies.
Healix offers an optional auto-renewing paid subscription ("Healix Pro") that unlocks additional features within the Service, including unlimited AI meal analysis, personalized health insights, advanced nutrition tracking, blood work analysis, and priority support.
Healix Pro is offered in the following auto-renewing subscription tiers:
Prices may vary by region and are displayed within the app at the time of purchase in accordance with Apple App Store pricing.
Payment will be charged to your Apple ID account at the time of purchase confirmation.
Your subscription will automatically renew at the end of each billing period (monthly or annual, depending on the tier you selected) unless auto-renewal is turned off at least 24 hours before the end of the current period.
Your Apple ID account will be charged for renewal within 24 hours prior to the end of the current period at the then-current renewal price of the subscription you selected ($9.99 USD/month for Monthly, or $59.99 USD/year for Annual, unless changed in accordance with App Store policies).
You can manage your subscription and turn off auto-renewal at any time by going to your Account Settings in the Apple App Store after purchase.
To cancel, auto-renewal must be turned off at least 24 hours before the end of the current billing period. Cancellation takes effect at the end of the current paid period, and you will continue to have access to Healix Pro features until that time.
Deleting the Healix app does not cancel your subscription. You must turn off auto-renewal through your Apple ID Account Settings.
If a free trial or introductory offer is made available, it will automatically convert to a paid subscription at the standard rate of the selected tier unless auto-renewal is turned off at least 24 hours before the end of the trial or introductory period. Any unused portion of a free trial will be forfeited when you purchase a subscription, where applicable.
Subscription prices are subject to change in accordance with Apple App Store policies. Where required, you will be notified of any price change and given the opportunity to review and accept the new price before it takes effect. If you do not accept the new price, your subscription will not renew at the new rate.
All subscription payments are processed by Apple through your Apple ID. Refunds, where applicable, are handled solely by Apple in accordance with the Apple Media Services Terms and App Store refund policies. MioMarker does not process or issue refunds directly for App Store subscriptions. You can request a refund from Apple at reportaproblem.apple.com.
Subscriptions are also subject to the Apple Media Services Terms and Conditions.
Use of Healix Pro is governed by these Terms of Service and our Privacy Policy. By purchasing a subscription, you acknowledge that you have read and agree to both.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.
To the fullest extent permitted by law, MioMarker disclaims all warranties, including but not limited to:
TO THE MAXIMUM EXTENT PERMITTED BY LAW, MIOMARKER SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, including but not limited to damages for loss of data, loss of profits, personal injury, or health outcomes, arising out of or related to your use of the Service.
In no event shall MioMarker's total liability exceed the greater of (a) the amount you paid for the Service in the 12 months preceding the claim, or (b) one hundred dollars ($100).
These limitations apply regardless of the theory of liability (contract, tort, negligence, strict liability, or otherwise) and even if MioMarker has been advised of the possibility of such damages.
Nothing in these Terms limits liability for death or personal injury caused by negligence, fraud, or any liability that cannot be excluded by law.
You agree to indemnify and hold harmless MioMarker and its officers, directors, employees, and contractors from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from:
Governing law. These Terms are governed by the laws of the State of Washington, without regard to conflict of law principles.
Arbitration. Any dispute arising from these Terms or the Service shall be resolved through binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. Arbitration will be conducted in Seattle, Washington.
Class action waiver. You agree that disputes will be resolved on an individual basis only. You waive any right to participate in a class action, class arbitration, or representative proceeding.
Small claims exception. Either party may bring an individual action in small claims court if the claim falls within the court's jurisdiction.
Opt-out. You may opt out of this arbitration agreement by sending written notice to support@usehealix.com within 30 days of creating your account. If you opt out, disputes will be resolved in the state or federal courts of Washington.
You may stop using the Service and delete your account at any time.
We may suspend or terminate your account if you violate these Terms or if we reasonably believe your use of the Service poses a risk to us, other users, or third parties. We will make reasonable efforts to notify you before termination unless immediate action is required.
Upon termination, your right to use the Service ceases. Data deletion will follow the process described in our Privacy Policy.
We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last updated" date. For significant changes, we will provide notice via email or an in-app notification. Your continued use of the Service after changes become effective constitutes acceptance of the revised Terms.
